By signing below, Client represents, covenants, warrants, and agrees that:
Client has contracted with MONTENEGRO PAPER LTD., an Illinois corporation d/b/a as Montenegro, Inc (hereinafter referred to as “Montenegro”). Client agrees in its own and sole discretion, to allow the name and image of those materials printed on Client’s behalf, whether as a photograph, video, drawing, caricature, digital image, or other likeness (collectively the “Images”) to be included on Montenegro’s website, social media, phone or other electronic applications, and/or other marketing materials. Client is not receiving any monetary compensation for this agreement, but Client is receiving the opportunity to be included in Montenegro’s website and marketing materials, which Client agrees is good and valuable consideration.
As a condition precedent to the use by Montenegro of Image, Client agrees and assents to all the terms of this Image Use and Release Agreement (“Agreement”). Client consents for Montenegro to photograph, video, or print the Images and to be otherwise artistically rendered for the use by Montenegro in its business and marketing. In addition, Client consents to be identified by name in the Images used by Montenegro. This consent does not extend to use or alterations of the Images in a way to suggest anything profane, sexual, illegal, or obscene (“Non-permitted Use”). Client agrees that Montenegro will own the copyrights and intellectual property rights to the Images and any materials created or distributed in connection with Images.
Client grants and assigns to Montenegro the absolute and irrevocable right and unrestricted permission concerning the Images that are taken or may be taken of or in which may be included with others, to use, reuse, publish, and republish in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, phone or other electronic applications, and for any purpose whatsoever (other than as specifically excluded above), including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration, other than for any Non-permitted Use. Client further agrees that the Images may be edited, formatted, revised, altered, or modified without Client’s review or consent.
To the fullest extent permitted by applicable law, Client waives all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages and expenses from any and all claims and demands (collectively the “Claims”) that may arise out of or in connection with this Agreement and/or the use of the Images.
This Agreement shall be binding upon Client for the Images. The signatory below certifies that the signatory is eighteen (18) years of age or older and that the signatory has the authority to bind Client. I have read and fully understand all the terms and agreements herein.
